The intersection of domestic and international dangerous goods regulations is one of the most complex compliance challenges in freight logistics. And it is getting more complex in 2026 as new editions of international codes take effect and enforcement activity increases across all modes.

Here is what every U.S. shipper needs to understand about where domestic rules end and international requirements begin.

The Foundation: The UN Model Regulations

The entire international dangerous goods regulatory system traces back to a single source: the United Nations Recommendations on the Transport of Dangerous Goods — also known as the UN Model Regulations.

These recommendations establish the foundational framework: the classification system, the UN numbers that identify hazardous materials globally, the hazard communication requirements, and the packaging standards. They are not law themselves — but they are the basis for virtually every national and international dangerous goods regulatory system in existence.

This is why you see the same UN numbers, hazard classes, and basic labels across different modes and different countries. The common language comes from the UN Model Regulations. What changes between frameworks is the specific application — quantity limits, packaging requirements, and the additional restrictions each mode and each national authority imposes on top of the baseline.

The U.S. Domestic Framework: 49 CFR

Within U.S. borders, the primary framework is PHMSA’s Hazardous Materials Regulations under 49 CFR Parts 100-180. These regulations govern ground transport, domestic air, and domestic maritime movements of hazardous materials.

PHMSA’s HMR preempts conflicting state and local regulations. States may impose additional requirements that do not conflict with federal standards, but they cannot set lower thresholds or create contradictory classification schemes.

One important and often misunderstood provision: 49 CFR Part 171 includes provisions that allow shippers to use international frameworks — the IMDG Code for vessel shipments and the ICAO Technical Instructions for air — under certain conditions and with some U.S. variations. That alignment is why domestic compliance work often provides a foundation for international compliance. But it does not eliminate the gaps.

Complying with an international framework under these provisions does not fully substitute for 49 CFR compliance. The U.S. DOT remains the enforcement agency in U.S. territory for determining compliance — even when a shipper uses an internationally authorized framework.

The International Layer: Three Frameworks That Matter

Each international framework builds on the same UN Model Regulations foundation — but each adds mode-specific and jurisdiction-specific requirements that can catch shippers off guard when a shipment crosses from one framework’s jurisdiction into another. Here is where the differences matter most.

IATA Dangerous Goods Regulations — Air Transport

The IATA Dangerous Goods Regulations govern international air transport and are generally the most restrictive framework — particularly on quantity limits and packaging requirements.

An important technical distinction: IATA DGR are based on the ICAO Technical Instructions, which are the legally authoritative framework for international civil aviation. However, IATA regulations do not have official standing within the U.S. The officially authorized framework is the ICAO Technical Instructions under 49 CFR 171.22 and 171.23.

In practice, most airlines — including domestic carriers on international routes — require compliance with the IATA DGR. A material that ships legally under 49 CFR ground provisions may exceed IATA DGR quantity limits for the air leg of a multimodal shipment. Shippers who do not check the IATA limits for the air portion of an intermodal move discover this on the dock when the carrier refuses the shipment.

IMDG Code — Maritime Transport

The IMDG Code governs international maritime dangerous goods transport. Amendment 42-24 became mandatory from January 1, 2026, introducing updated provisions on segregation, stowage, and documentation for several hazard classes.

The IMDG Code is authorized for use under 49 CFR 171.22 and 171.24 for vessel shipments. Shippers using the IMDG Code must still comply with applicable additional U.S. requirements — the international code does not operate as a complete substitute for 49 CFR.

Transport Canada TDG Regulations — Cross-Border Ground

For shipments crossing the U.S.-Canada border by road, the Canadian Transportation of Dangerous Goods Regulations apply the moment the vehicle enters Canadian territory. Canada’s TDG Regulations are broadly harmonized with the UN Model Regulations and are authorized under 49 CFR 171.22 — but they have specific requirements that differ from the HMR, particularly around documentation and the use of UN portable tanks.

The Multimodal Problem

The most common compliance failure in international hazmat shipping is not ignorance of any single framework. It is failure to verify compliance at each leg of a multimodal move.

When a material ships multimodally — for example, by truck to a port and then by air — the shipper must verify compliance against each applicable framework for each transport leg. A material that ships legally under 49 CFR ground provisions may exceed IATA DGR quantity limits for the air leg.

This verification step is where most cross-border hazmat compliance failures occur — not in the classification itself, but in the failure to apply the right framework to the right leg of the journey.

What This Means for U.S. Shippers in Practice

The practical takeaway is straightforward. The same classification work used for DOT ground and domestic air becomes the foundation for IATA air and IMDG ocean — but there are still gaps to close. Quantity limits, packaging specifications, and documentation requirements must be verified against the specific framework governing each leg of the shipment.

Shippers who move hazardous materials only domestically need to master 49 CFR. Shippers who move hazardous materials internationally need to understand how each international framework intersects with domestic requirements — and where the gaps create compliance exposure.
